my e6750 without loading windows up, just in the bios is showing 38oC idle.
is that bad, because it seems it.

No, it's not a bad temp at all.

It's higher than I would expect, but then that's dependent on your cooling setup, and if you've got a mobo that dynamically increases performance to the cpu by upping it's speed and voltage. Voltage creates heat. If you have got a mobo that does this, do you have it set at 'performance' or 'peak' (however it's worded) ?

But regardless of that, again, that temp is fine.

If that is with the standard heatsink using a better HSF will lower the temp.

Remember that the CPU temp you see in BIOS is the temp of you CPU under load.
Not 100% load but maybe 80%.
38C under 80% load?
Id be happy.
Download TAT to analyse idle and load temps from desktop.

well as per recommendation from you alex i got the ga-p35-s3 gigabyte board.
awesome board btw. and yeh under the bios settings it says its set to turbo mode.
3 modes being: standard, turbo and then extreme.
maybe change it to standard if i get any bad temps?
or maybe invest in a new heatsink?

Thanks for the kudos there Necro and I'm glad you're happy with the board.

Regarding the modes; There should be one that allows you to turn off any dynamic changes to the fsb, voltage etc. If not set it to standard.

If you're still concerned over the 38c (and are running the generic Intel HSF) then yeah, invest in a new one. Arctic Cooling Freezer 7 pro would be my choice. Not least because it's so cheap considering it's performance. If you do that get some AS 5 T.I.M. May as well do it all if you go that route.

It's not the 'idle' temps that concern me (within reason of course) in setups, it's the peak temp's that you want to be looking at. What's it like when gaming?

To stress both cores of your CPU properly and see temps at 100% usage use Orthos .

i think i may invest in a new heatsink then. iv never really liked the supplied ones anyway,

everything seems okay now.
in windows and doing mild editing work, my temps show 29 degrees.
when gaming my temps show average 36 degrees.
